1. WHAT DOES THIS PRIVACY NOTICE COVER?

In this privacy notice, we provide you with information about how and why we, as a data controller, process your personal data for the following purposes:

2. WHAT TERMS ARE USED IN THIS PRIVACY NOTICE?

Customer means all users of our services.

Personal data refers to all information about the data subject or information that can be used to identify the data subject.

Data processor means a person who processes personal data on behalf of the data controller.

The purpose of the processing means the reason why the data controller is processing the personal data of the data subject.

Legal basis means the legal basis on which the data controller processes the data subject’s personal data. The legal bases are described in Article 6 of the General Data Protection Regulation.

Data controller means the person who is responsible for the processing of the data subject’s personal data.

Data subject means a person as defined in data protection legislation.

A privacy notice means a document drawn up in accordance with Articles 13 and 14 of the EU General Data Protection Regulation in which the data controller informs the data subjects about how the data controller processes their personal data.

4. DOES B METERS NORDIC AB ALSO ACT AS A DATA PROCESSOR?

Yes – we also act as a data processor in the Hydrolink Online and Hydronet services when we process personal data on behalf of a housing company or waterworks that is the data controller. In other words, we process personal data in the Hydrolink Online and Hydronet services only because the housing company or waterworks has decided to use our cloud service for water metering, which requires personal data to be uploaded and processed in the service.

When we act as a data processor, we process personal data in accordance with the data processing agreement in force at any given time.

If you are a resident of a housing company and want to know more about the processing of your personal data in the Hydronet or Hydrolink Online service, please contact your housing company’s property manager or the contact person of the relevant waterworks directly.

5. WHY DO WE PROCESS YOUR PERSONAL DATA?

We process your personal data in accordance with the purposes of processing indicated below. The sections on the purposes of processing contain information about which personal data we process and the legal basis on which we process your personal data.

a) Customer relationships with buyers of products supplied by B Meters Nordic AB

  • Explanation: We process personal data in order to manage customer relationships in connection with our products.
  • Categories of data subject: Customer/customer’s contact person (if the customer is a legal entity).
  • Categories of personal data: Basic information, contact details and bank account details (if the customer is a natural person).
  • Legal basis: Performance of contracts.

b) Customer relationships with waterworks that use the Hydronet service

  • Explanation: We process personal data in order to manage customer relationships in connection with the Hydronet service.
  • Categories of data subject: Contact persons of the waterworks
  • Categories of personal data: Basic information and contact details.
  • Legal basis: Performance of contracts.

c) a) Customer relationships with housing companies that use the Hydrolink Online service

  • Explanation: We process personal data in order to manage customer relationships in connection with the Hydronet service.
  • Categories of data subject: Contact persons of the waterworks
  • Categories of personal data: Basic information and contact details.
  • Legal basis: Performance of contracts.

d) Strategic analysis of customer data to help us develop new services and meet customer needs

  • Explanation: We process personal data in order to develop new services and meet customer needs.
  • Categories of data subject: All customers and any contact persons.
  • Categories of personal data: Basic information and contact details and information about the use of our services.
  • Legal basis: Our legitimate interest, in order to develop our services. Our interest overrides the interests of the data subject, as we process personal data in accordance with applicable legislation.

e) Collaborative relationships

  • Explanation: We process personal data for purposes relating to collaborative relationships.
  • Categories of data subject: Collaborative partners (contact persons).
  • Categories of personal data: Basic information and contact details.

f) Marketing

  • Explanation: We process personal data for the purpose of direct marketing by email or ordinary post.
  • Categories of data subject: Customers.
  • Categories of personal data: Basic information and contact details and information about the use of our services.
  • Legal basis: Our legitimate interest, as we need to market our services in order to run our business. Our interest overrides the interests of the data subject, as we market our services in accordance with current legislation.

g) Communications

  • Explanation: We process personal data for communication purposes.
  • Categories of data subject: People who are in contact with us.
  • Categories of personal data: Basic information and contact details and other information that may have been provided to us.
  • Legal basis: Our legitimate interests, as we need to communicate in order to run our business. Our interest overrides the interests of the data subject, as our data subjects assume that we will communicate with them.

h) Cookies

  • Explanation: We process personal data in order to use cookies (for more information, see the cookie notice).
  • Categories of data subject: People who visit our website.
  • Categories of personal data: IP addresses.
  • Legal basis: Consent to non-essential cookies in accordance with Section 205 of the Electronic Communications Services Act (917/2014).

i) Recruitment

  • Explanation: We process personal data for recruitment purposes.
  • Categories of data subject: Job applicants.
  • Categories of personal data: Basic information and contact details, CV information and other information provided to us.
  • Legal basis: Our legitimate interest, in order to manage our recruitment. Our interest overrides the interests of the data subject, as our data subjects assume that we will process their personal data for recruitment purposes.

j) Compliance with statutory obligations

  • Explanation: We process personal data in order to fulfil our statutory obligations as a limited company.
  • Categories of data subject: All customers and any of their contact persons.
  • Categories of personal data: Personal data that is required by law, such as accounting material.
  • Legal basis: Our statutory obligations (e.g. the Auditing Act).

6. WHERE DO WE OBTAIN YOUR PERSONAL DATA?

We obtain your personal data from various data sources. The specific data sources that we use depend on the purposes of our processing.

We obtain your personal data from you, from our collaborative partners, authorities and various public sources, such as the trade register.

f) Marketing

We obtain your personal data from you during the customer relationship.
We purchase customer data to enable us to send information and marketing materials by email or ordinary post.

h) Cookies

We use cookies to obtain your personal data.

i) Recruitment

We obtain your personal data from you when you send us a job application. If you send us a job application using the recruitment service of a recruitment service provider, we obtain the data you have provided from such systems.

7. DO WE DISCLOSE OR TRANSFER YOUR PERSONAL DATA TO OTHERS?

As a rule, we do not disclose your personal data to third parties. However, where we are required to disclose your personal data by mandatory legislation or by the authorities, we and our data protection officer will assess the legality of such disclosure on a case-by-case basis.

We do however share, or in data protection terms we transfer, your personal data to others as part of our standard business practices when using various digital services. We use the following digital services that are provided by data processors and which involve the processing of personal data: data storage services (e.g. cloud services) and communications services (e.g. email). When we transfer personal data, we ensure that such transfers take place securely and are based on appropriate data processing agreements.

8. DO WE PROCESS YOUR PERSONAL DATA OUTSIDE THE EU OR EEA?

Your personal data may be processed in a third country outside the EU and EEA. Where this is the case, we ensure that there is an appropriate level of data protection, for example using the European Commission’s standard contractual clauses and other similar arrangements.

9. HOW LONG DO WE STORE YOUR PERSONAL DATA?

The length of time we store your personal data for depends on the purpose for which we process your personal data. We perform regular checks to ensure that the data contained in our records is necessary and we document these checks.

We store your personal data for as long as the contractual relationship between us exists.

d) Strategic analysis of customer data to help us develop new services and meet customer needs

We store your personal data for as long as is necessary for the purpose of the processing.

f) Marketing

We store your personal data for as long as it is relevant or until we are informed that you no longer wish to receive marketing.

g) Communications

We store necessary personal data for three (3) years after being in contact with you.

h) Cookies

The retention period depends on the cookie.

i) Recruitment

We store necessary personal data for a maximum of twelve (12) months after receipt of your job application.

10. WHAT ARE YOUR DATA PROTECTION RIGHTS?

You may be entitled to exercise rights under the EU’s General Data Protection Regulation (2016/679):

Contact in relation to rights must be made in writing to the data controller’s contact person. You can only exercise your rights once your identity has been verified in an appropriate manner.

You may be entitled to lodge a complaint with the Data Ombudsman if you consider the processing of your personal data to be in breach of data protection legislation.

11. CAN CHANGES BE MADE TO THE PRIVACY NOTICE?

We may change the privacy notice unilaterally. We will update the privacy notice as necessary, for example in the event of legislative changes. Changes to the privacy notice will take effect immediately, as soon as we publish the updated version on our website.

If we make significant changes to the privacy notice or if its application changes significantly, we will notify the data subjects of this.
